My H-1B expires next year (after 6 years). I have been here 10 years (on J-1 and then H-1B visa). My employer isn't in a position to apply for Labor Certification, although they want to continue hiring me. I want to stay (no relatives here etc.). I know after one year, I can return on a new H-1B if my employer will petition again but it is messy and I want residency. I am from Britain. Help!!!

Hello, my wife and I have been approved and got notice of action (I-797C) in mail May 23 (recieved date May 22). Online USCIS states our cards went into production June 13th and allow 30 days to recieve. We have not moved but will in mid August in order to begin work under OPT. We called USCIS service center on 1-800-375-5283 on 30th day and put in a trace on our cards. USCIS states case will be assigned within 30 days and then expect within 45 days to hear. This is impossible as we hope to begin work before that. I know that calls can be made to get permission to work as we are F-1 graduating Aug 8th BUT need the cards for our bank to approve financing.
Question - is there any way to make direct contact with someone who can tell us the card WAS mailed and provide confirmation. It is odd that regulkar mail delivers such a valuable, time consuming document.
Any comments would be helpful.

I am working for a client which gave me an offer for a respectable amount. it is much higher than the amount specified in ETA 9089 (F/5) column. my Onet code for the original labor is 15-1071.00. my new job is defined as System Specialist. my job functions( roles) are pretty much the same as my original labor certificate. I tried to search the Onet Code for System specialist and did not find a good match.
Can any one suggest me what are the options.
I also wanted to know weather USCIS will send any letter to new employer regarding to the offer extended to me. MY situation is the client is not willing to sponsor me.

CAN WE APPLY 140 and 485 without physical Labor APPROVAL?
My lawyer emailed me saying that she called P-BEC and my LC is approved. We neither have the physical paper nor the online status shows "In-Process"

Hi guys, cannot find this topic in previous threads. Appreciate it if someone can advise!
My situation is: I'm still waiting to file for I-485 with approved PERM and I-140. I'll get married right after I submit my I-485 when visa number is available and petition for her I-485. Can my future wife in China take consular processing in US consulate in China while I'm just waiting for approval in US? Normally, does she get it earlier than me since she'd ask for consular processing?

Hi Guys,
My I-140 was processed at the Nebraska center, but my attorney sent the I-485 case to Texas Service center. Since my I-140 was filed at Nebraska, I was expecting my I-485 would be sent Nebraska also.
Should it be sent to Texas center or Nebraska?

Unless some political goof up turns, economy seems to be getting brighter and brighter. This might help translate into more jobs and opportunities..

Currently my 485 is pending over 1.5 years with I-140 approval (2007). I was laid-off. I have valid EAD card. Am I eligible to transfer to a TARP company for a similar position but in different state? Is there any specific policy or limitation for this work status? The company's HR couldn't make a decision. What should I do? Thank you very much for your kind and generous help.

seems to say that as long as you have a valid visa (which a greencard is a physical manifestation of an immigrant visa) then you should be ok.
Assuming your son is a US Citizen - he won't need one either.

Hi there!
I was reading some info abt EAD on this site and have come to know that Once H4 visa holders get their EAD's can work after getting SSN.But I read that If H4 visa holders start working as soon as they got EAD's.Does this invalidate H1 visa status if wife starts working on EAD.Please clarify my doubt.

Can the IV core group can come up with the webfax to explain our reasonable concerns (to educate the Title V of Senate bill) to all members of congress (House and Senate Members)? I just checked my status on line and saw a LUD on my and my wife's pending 485 applications. My priority date is March 2006.
One reason that I am thinking off is that i had a service request opened on 8/22 when i went for infopass appointment and I recd a letter from USCIS dated Sept 30th with the usual template of saying that "we are processing your application bla bl bla and if you dont hear anything from us in 6 months please call us bla bla bla....."
However the LUD is not 9/30 but 10/7. I am wondering if anyone else has seen LUDs on their applications.
My AP and EAD have been renewed long back (about 1 month back).
Any response in this respect is appreciated
