I am really confused and I really need information about my situation.
I have graduated from Culinary Institute of America on June 18 and I had an application for OPT for July15. In normal process, I have received my OPT card and begin to work at the restaurant on July 15. However, because of an important family situation I have to go back to my country for one week between September 15- 22.
Now,my situation is; -I have an OPT card
-I have a job
-I am in my OPT year
BUT: on my OPT card, it says that, I can not leave the country during my OPT year
HOWEVER: I have to go back to my country for one week and there is no problem about taking off from my job.
I can not be sure about leaving the country,my question is: During the OPT period, IF you have a job and all your documents are done about OPT period, are you still should not leave the country? If you leave the USA, how can you come back?

or should it be filed from Tx where I live and work from home

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. Hi Friends,
My EAD expires in the mid of August.I am planning to go india at last week of July.I thought of applying for EAD renewal now.But my lawer said it is always preferrable that the candidate must present in US while processing EAD renewal.Is it ok if I apply for renewal after I come back from India.By that time,My EAD already expires.Will it be a problem If I apply for renewal after expiry of current EAD.I am currently on H1B visa and I am not using EAD status now.If it is a problem,I will postpone my India trip.

I was laid off in Dec 2009, but severance will stop till early Feb. Now I found two potential jobs. Company A is a corporation in same state, but company B is a university in some other State.
1. How long will take them to transfer my H1B? does the different States matter on this transfer time? I want to make sure which one can submit the H1B transfer before my paycheck stops in Feb.
2. In order to apply for Green Card later, which job is better for Green Card application? I heard university will not help the staff (accountant) for Green Card application. Is that true?

Hi,
My family had visited me way back in 2004 on a visitor visa. Due to unavoidable circumstances, they had to stay beyond the stipulated 6 months ( for 2 more months). We had requested the govt. for extension approval and it had been granted then.
We would like to have them visit us again by Nov of this year. However, when they went for the visa to consulate(last week), it got rejected, because the consulate person informed them that they had overstayed last time around.
I would like to know when can I legally apply for the visa again? And is there a way I could enhance my chances of an approval, rather than a rejection, next time I try. I am working on an EAD and my husband had filed for I485 for our family(I140 approved stage).
Any advise would be appreciated.

My questions are about F1 to H1b change status.
I applied an H1b through a consultant company on April 2008. I received a notice from USCIS told me had been lottery H1b. However, until now my case is still pending. My OPT expired on Jan, 2009 and can't be extended. I am in the middle of the 60 days grace period right now. My questions are:
1. If the 60 days expire and my case is still pending, can I legally stay in US till H1b approved?
2. If my H1b is rejected and the 60 days expire, how many legally days can I stay in US? Do I have another 30 grace period days?

Actually the change of status was meant to ask if the L1A gets rejected - can he move to L2 or H1 with change of status without leaving the country.

You can only stay in the US if you can change to another lawful status. As a UK citizen, the only work-authorized status that might be available, though difficult, is O-1 for extraordinary ability aliens. I was on H1 visa and laid off from job on 10/30/09. I got severance pay for Nov. and have the pay stubs. I applied for COS from H4 to F1 for my spouse (already in collage) and H1 to F2 for me on 12/9/09. Meanwhile immigration performed spot check at my ex-employers on 12/3/09, so they came to know that i was not working. My employer had not revoked H1 by then. Our COS application was received by USCIS on 12/14/2009, case is currently under Initial Review.
- Will the immigration officers who did spot check inform USCIS that i was out of status?
- Will case get rejected due to delay in applying for COS?
- Will there be any complications in transferring my H1 to new employer as i was out of status for about a month before i applied for COS?

My I-485 application was filed under EB3 category when I was working for my previous employer (PD - October 2006). I changed my job in August 2008, but never sent any documentation for AC21. I now have close to 8 years of experience and also a masters degree (MBA) from a reputed univeristy here in the US.
Now that EB2 dates are so close to October 2006, is there anyway I can port my application from EB3 to EB2? I can initiate this discussion with my current employer and may be able to convince them to help me. But I want to know exactly what needs to be done.
