Hello, I really appreciate a lot if anyone here could help me on this..
The company I have been working with an H1B for a years got recently restructured to a new firm and it filed a H1B transfer for me this Feb. The petition got an RFE and the firm made an Appeal, which is now pending. The job looks now rather unsecure and I am not sure if the company will continue sponsoring me for a new H1B if this transfer got denied in the worst case scenario..
So my questions are:
1. Can I file a COS to F-1 while my H1B transfer appeal is still pending?
2. If my H1B transfer appeal got rejected, or I got laid off while it's still pending, after that happened is it still possible and in time to file a COS to F1?
I am really worried about my current situation now, and thank you very much if you could kindly help on it!

The USCIS announced on June 1, 2006 that the regular H-1 cap for Fiscal Year 2007 (FY2007) was reached on May 26, 2006. Those cases properly filed with the USCIS before the 26th are safe, with respect to the cap, as there are enough cap numbers for these cases. Cases that reached the USCIS on May 26th are in an uncertain situation and will be subject to a random selection process, as there are enough numbers for some, but not all of the May 26th cases. Any regular cap-subject cases received after May 26th will be rejected entirely.This information does NOT impact advanced degree cases, for which cap numbers are still available.

Hi,
My Spouse Application was rejected due to incorrect fee though the USCIS were accepting application with old fee till august 17th! It was filed on August3rd! and it was with old fee! Will it be accepted if we send a letter that the fee was right the first time!
Has anybody's both primary and spouse applications got the receipts with old FEES and had applied in AUGUST, Pls reply asap as my spouse application rejected and we had applied on august 3rd!

It should be okay. I sent to my attorney as well as my HR. I do not see any issues as long as it is just GC copy.
My attorney asked me to send a copy of my GC to make sure the info is correctly printed. Is it ok send it to them?

When my employer looked up my case number on the DOL site, the case status showed as "certified" and apparently when he downloaded the certified ETA 9089 the section where it says "Signature of the certifying officer" doesn't bear CO's any stamping/signature.
My employer came to know this only yesterday obviously 'coz he overlooked and we just have two more months remaining on this PERM validity. My employer also said he can't file for I-140 unless we hear back from the DOL on the CO signature issue.
He has apparently emailed DOL asking for clarifction on this.
1. Would DOL even bother to look at the incoming emails after the case has been approved?.
2. Does CO's rubber stamp signature really required for 140?. What if we don't hear back from DOL on time, can we just go ahead with 140 filing?.
3. I am on my 6th year of H1b.
Any response on this matter is truly appreciated.

Hi,
Once our 140 is approved in the sixth year of H1B, I learnt that we can seek a 3 yr extension. If that's the case, can we change companies during that 3 yr period or are we stuck with the same company that sponsored the 3 yr extension?

I think it is within 6 months. Check the USCIS website for the I130 petition time frame (CSC).

I think you should be ok as long as the I-140 isn't revoked. Green card is for future job and so you dont need to be currently working for them.

Now I got into a situation where in I need to file a new H1B with a new employer through whom im working on a project.But once my H1B is approved, my new employer will dismiss/cancel the new H1b Filed, as they just need to show that they filed a H1B for me.
Will this be a problem for my current 140 and GC processing or my existing H1B?
Coz that Im not going to use my new H1B, I can still continue using my current I94 right!
Any issues if my new H1b gets rejectd or queried!

I need to apply for an extension for 3 more years, i get my first H1B from 10-04-2008 to 08-31 but i'm not sure about the process to extend my H1B, i dont now if i need re-enter in the visa lottery like the first time.
Extensions don't count against yearly cap numbers. So, you can apply for the extension 6 months before your current petition expiry (feb 2011).

Another friend of mine (same company) was in the same boat, but his processing was like 3 months ahead of mine(for all these steps). His Appeal was sent to BALCA and he is waiting for their response.

My company has just started my GC process and the Prevailing Wage is the first step before they can post my job.....
