Hello,
I am on H4 currently in US:
1) If I start working next month in india, is it advisable to go immly for H4 stamping? Any chances it can get rejected?
2) If I plan to go back to school for Fall 2010, what are the chances of getting F1 stamping later on ?
3) Does it matter if I wait till I get admit or reject (which maybe 6 mo's from now) then go for H4 or F1 stamping?

Well this came out of nowhere. Last night the Senate passed an emergency border enforcement bill that provides $600 million for increased security on the southern US border. The $600 million will come from raising fees on staffing companies. The fee will increase by $2250 for each L-1 visa application for companies that employ 50 or more workers if 50% of the workforce is on an H-1B or an L-1. Hi,
My company filed for my GC in June'07. They goofed up and filed under EB-3 instead of EB-2. The company apologized and is ready to change my filing to EB-2. I am wondering whether this would be a good step? Following are my details.
- My PD is June07
- Labor is approved (in 1 week)
- I-140 approved
- My 6 yrs on H1 were completed in July09
- I have received 3 yr H1 ext
- Me & Spouse both have received EAD (I am not using my EAD card)
I am not tracking the progress of visa number availablilty, but I presume that EB-2 would anyday be better than EB-3.
Please advise whether chnaging to EB-2 would be a good idea?

I recently got an RFE for my I 485 Application.
Need to prove my non-immigration status from Nov 29 2007 to Nov 24 2008 .
I have I-797 ( H1-B approval ) for the above mentioned period. But My Last Name in the approval has a typo error ( in place of letter A they misstyped U). My Enployer has opened a Service request to correct the Name in H1 B approval. But he is saying that he never got the corrected approval. Time went by and i applied for H1 ext..i got the H1 extension from Nov 25 2008 to Nov 2011.
So My question is
Is it okay to submit all the documention that was sent to USCIS to correct the name along with the I 797,I-94 for the above mentioned period and explain them that we did not recieved the corrected I-797 ? or not
Please suggest me ..

1. I got laid off from company A last year. I was on H1B. Company A notified me about 1 month in advance so I had some time to find another job. I also had a valid EAD which I wasn't using at that time. They also did not cancel I-140.
2. I joined Company B using my EAD within the 30 day period, so I never went out of status. Also, I didn't file AC21
3. My GC application was approved in the first week of Aug.
I have a couple of really interesting opportunities that I would like to pursue. My job profile has been similar at both A and B and will likely be similar even in C should I join there. Am I required to work at B for any specific period of time before I can pursue these opportunities?

Do you know how long it takes for the SWA order to be posted after a job order has been requested with the SWA?
Is it immediate or does it take some time for the SWA to process the job order and then post it?
Also do you know where we can see the job order after it has been posted? Is there a public site where we can see the jobs?
Any response is greatly appreciated, especially if you know about mass.

Hello,
It has been over two years I got my EAD, and I am also on H1 and my H1 is valid up to May, 2011. Now, if I want to switch to a new employer, I want to know if there are any complications...I read that we can always switch to new employer and can still retain the priority dates. Is it true? What is NOID? Is it possible for the old employer to revoke my I-485? or can they do anything that affects my Green Card status or the legal status in the country?

The tour is on March 11, 2010. It will begin at 12:15PM and end at 1:00PM. From 1:00PM to 2:30PM, CSC officers will meet with the visitors and answer questions. The topics will include best practices for filing and advice HR professionals should give their foreign workers. Is there a time frame by which I need to renew passport? Can I go sometime this month or should it be within 6 months of expiration?

I am sure that IV core team organizes events and actions pretty well. I know there are usually action items that get posted on IV.
How about thinking about the action items in a different perspective. For any event/action, create a task force. Ofcourse that may have been what is done as of now. But all am saying is create a taskforce every action/event to be organized at different levels vi.z, IV Core, IV State, IV Local and create a menu item called TaskForce on the main page. Anyone who is interested in a particular event or action would get in touch with the taskforce team.
Not sure if it makes sense but just a thought of coining a different name for the action items with assigned roles and ability to contact easily.
