    Hi,

    My wife has a stamped H4 visa & I-94 both are valid through Oct 16th 2008. We have applied H1B for her which got approved somewhere in May 2007.
    The Approved H1B documents along with new I-94 is with her employer.
    We have some issues with the employer so we are not sure that we can get the H1B & I-94 documents from her employer.
    As we also applied for EAD,In the mean time if we receive her EAD card and Travel Document for my wife.
    Do we still need her H1B and new I-94 documents from her employer for any reason?

    Any advise is well appreciated.

    H-1B visas are a relatively swift path to employment for foreigners with bachelor's degrees and U.S. employers to sponsor them. Each year, the U.S. government makes 65,000 H-1B visas available to qualified individuals on a first-come basis. The cap has been reached every year for the last several years, and for fiscal year 2008, it was reached on the first day of filing.     I heard that if the current state u work in State A , is not the same as the one labor was filed - State B , then it can trigger an RFE.
    My Q is HOW frequent is this possibility ? Has anyone experienced this ? Also my PD WILL Be current next month and I filed AR 11 about 10 days ago . Will that impact ? I read somewhere someone posted an article that change of address can tigger RFE at 485 Stage.But changed address in the same State B , I have been working in since 2008 ( I filed 485 in 2008 from State B ) . The change of address is only some 20 miles away from the previous one.
    Any clues .. folks ? thanks

    Hello Attorney,

    I filed AP for me and my Dependent , Unfortunately USCIS just picked the application on the top of packet ( My Application ) and i got the receipt No , I dont know what happened to my Spouces Application her check is not cashed and no receipt no , I suppose her applicaiton is was just placed with my applicaiton and was considered as just one application .

    Now what are my options , can i go ahead and file one more application , i know its literally impossible for me to call uscis and Track my wife's application , can i go and file a new application for my Spouse . Please advice.

    Hi,

    I applied for EAD renewal at NSC on 07/03/08 and today 08/06/2008, the status shows card production ordered. I applied for my wife along with me and her status shows still received.

    Does the dependent (spouse) EAD in general get approved a few days after the primary applicants EAD is approved? I am not really using the EAD, its my wife who is using it, and thats the concern.

    It seems USCIS has set a quota of �X� number of 485 applications till SEP �07.Once that quota reaches, dates will retrogress.
    After that 485�s will be processed by PD and not by RD.

    This is such an open ended question. It will be very easy to answer if you can add few lines about your background, affordability and qualification(like GRE etc). If not the school names will be all over the place from MIT to the ABC University....as the word "Good School" is very subjective.

    Hi,

    My wife has received the ASC notice of biometric appointment. But I did not. She filed as dependent of my concurrent I-140 + I-485 case. I am wondering if there is anything wrong. Should we receive the notice together? Or it is normal to have seperate appointments? Then how long could be the interval between the notices? Anyone in the same situation before? Could I find it out by Infopass appointment?
