If she gets J1 visa, then she would have to stay outside of US for 2 years at the end of J1 visa before she can get her greencard (even if you become citizen and apply for her). Another option would be that she would have to work in medically underserved region for 2-3 years to obtain J1- waiver, before she can apply for greencard.

Hi -
I got my I-140 approved back in 2008 and last year my H1b was extended for another 3 years.
I am planning to change job now and once the new company transfers my H1b will it be extended for another 3 years or for the remaining duration of my current H1B.
Also what happens if my current employer revoke the I-140 after i change job?
Until when can i start the GC process with new company so that i don't go out of status and keep getting extensions until i get my GC?

USCIS has specifically answered a very similar question in 2004. The answer is "A change of status take effect automatically on the effective date noted in the [approval notice], even if there is an intervening admission...."
Your H-1B status should therefore take effect automatically on 10/1/09, assuming it was approved as a change of status.

The analysis of census data from both the U.S. and Mexican governments, being released Wednesday by the Pew Hispanic Center, highlights the impact of the economic downturn on Mexican immigrants, many of whom enter the United States illegally. The study found that immigrants arriving from Mexico fell by 249,000 from March 2008 to March 2009, down nearly 60 percent from the previous year. Yes, you have to file a change of address form.
Also make sure your employer files an LCA for the new location.

My wife has H1 approved. Currentlyy she is in India. Her H1B will start from October 1st. I had 2 questions:
1. For stamping does she have to wait till Oct 1st or she can go before also?
2. Based on question 1 if she can go before oct 1st and get visa, can she enter US before 1st october?

Hi All,
I am sure this has been discussed in detail before but I couldn't find the related threads..So i am posting it again..Sorry for the spam..
My wife converted from H4 to H1 last year (H1 started Oct 2007). She has been working for the H1 sponsoring employer since 10/1/2007...She plans to take a break now and relax for a few months for personal reasons...Can we update the I-9 form with her EAD info and work for a few days and then take a break...I know by doing this she will lose her H1 status but we are fine with that as she will be using her EAD moving forward...I am a July 2nd filer with 140 approved, so I dont see any risk in my I-485 as it is a pretty straightforward case...Have been with only 1 employer since Jan 2001 with PD: Nov, 2003 EB-3 India.
I just wanted to check if this is ok...Any thing that we need to look into before changing the I-9 to EAD....

(1) I have applied for my OPT very recently with a start date of oct1, 2007 and its in the processing stage.
(2) I am planning to apply(say by August 1st, 2007) for 140/485 concurrently in EB2-NIW category, as the PDs have become current.
Will my OPT be rejected because of the pending 485? Is it possible to file 140/485 concurrent or should I wait till my OPT is approved (by that time the PDs will no longer be current...hmmm). Your valuable suggestions are needed. Pls help me....

Please submit contracts, statements of work, work orders, service agreements or letters from/with end-client firms requiring computer related services of the beneficiary. Evidence from other consultants or employment agencies not acceptable. The requested evidence should show specialty occupation work with the actual end-client company where the work will ultimately performed.

I have renewed my AP third time now; All three time AP went to lawyer; This time it was a record 15 days for AP approval. USCIS is getting it done superfast looks like.
