Most people showing their cool wisdom still not getting the point. A BEC person with Feb 2005 PD may not be able to file for another 2 years while a PD 2007 person will be enjoying EAD during that time. In my dictionary this is injustice. And that's why i was kinda happy when they updated the July bulletin, now I'm not really happy even if my company has already filed my 485/EAD on july 2. I'm still wishing (and i'll be honest) USCIS come up with a reason/regulation/rule that will delay EAD for everyone until BEC people are able to file 485 OR in Oct they retrogress only till March 2005.
P.S. if you are superstitious, you want to know this: most of my relatives/freinds call me "Black Tongue" because usually when i say something unpleasent it happens. e.g. i told my wife last month that i don't believe everyone is able to file 485, something will go wrong and everyone will be disappointed. (when everyone expects something it does not happen- contrarian theory)

Lets divide in to Four categories :
1. PPL who has to still enter US

3. PPL whose Labor pending in BEC
4. PPL whose 140 pending or approved.
In each i have not seen advantages but these are disadvantages , please enlighten me about advantages over current system in each cases.

Case -2: For people who have not stated GC yet , its utter chaos, as per the dates in CIR. Now point system is not tested, there are severe imbalancements , No up system yet in INS , no yet personnel allocation . I dont see any reason INS will be on to this even if passed for atleast 2 years.
Based on this even if people say 5 years or so , no one exactly knows it might even take more than 7 years becoz of initial filing delays , accessing points , etc . What about extensions in H1B , anyways H1B system is so scrwed up consultants will be reduced by atleast 50% , and only survive who can find an work around. after all this High filing will force many out. I dont see anything good with new system. No big diff in Visa allocations to say that it will be faster for ppl. H1B Cant be renewed 3 years. Now is there any advantage over old sytem ? I dont think so .

1) Can one person have multiple H1 with different companies at the same time ?
2) Will he able to come to US using any of his H1 ? If not, which one he can use ?
I am having H1B valid till apr 09. I am in currently in US working with company 'A'. Now, they are asking me to go back as my assignment is over. I had signed a contract with company 'A' so I have to return and stay for 6 months there.
1) If I transfer my H1 to from company 'A' to 'B' before going back, will I be able to come to US for company 'A' not for 'B'(if I changed my mind) ?
2) If I don't transfer my current H1 to any other employer and and return to my country. Will my H1 visa be still valid till Apr 09 ?

My company lawyer did the filing for me and I just followed the same instructions to file for AP renewal for my wife. I did paper filing (trying to save a trip to the USCIS office for photo/fingerprints).
Supporting docs I sent other than I-131
1. $305 check for US Dept of Homeland Security ( write the A# on the "for" part just for safety)
2. 2 photographs ( name and A#s at the back , again for safety, in case the great people in USCIS manage to loose the photo from the application )
3. Valid photo identity ( Passport photo page )
4. I-94 for both me and wife ( I have a valid I-94 from my new H1B extension, wife's has expired, still sent it)
5. I-485 receipt
6. Cover letter ( just stating these docs are attached, and my I-485 pending, please be kind and give me AP ;) yada yada yada ... )

I know people applying for any kind of immigration document tend to send more supporting documents with the belief "more is good", but I believe ( and my law firm supports) USCIS have all the documents in our files, so it's better to send only what is required and not to confuse the USCIS staff with redundant bunch of documents. Just my thoughts, please, no preaching !

We should focus on spreading awareness about IV. I can't believe I was totally unaware of IV's existence until a month back. I haven't done much but felt strongly about what IV's doing. Me and my wife attended the rally and even contributed for the first time ever. We should brainstorm on how we can get more people on board and on how to transform members into contributors.

I know everything, i have been following these forums from past 3 yrs, but i responded to the post by ksircar, he said "I think some SELFISH people with recent PDs are scared as people with older PDs may take the quota" which was inappropriate, cursing core members or people who are eligible to file 485 doesn't help right? that's all i want to say.
Here I want to make clear, FIFO for taking labor applications and sending ad instructions not for approving. I know depending on compilcation of cases(I think), some cases with PD 2005 get approved fast and cases with PD 2003 are taking longer. I dont know why all these mess in DOL, for taking the labor applications and sending ad instructions.

We are Canadians too. IRS ruling is that if even a single person on your tax does not have a SSN, no one gets any stimulus money. Seems too weird, but that's what they say. For paying taxes, we are considered "US Persons", and should pay taxes not only on US income, but on World income (even on RRSP income within the plan unless you make a special filing to get exemption).
We are Canadian and on a visa, our son is an American citizen and we also cannot get the stimulus, not even our son's $300 which is wrong!
People do not care about the immigration problems because most do not know about them or understand them. It is a very unjust system that encourages illegal immigration and discourages allowing educated, upstanding people from coming here.

Guys this is great, we can all ask our friends and colleagues to sign letters and we can all secure them by paying for the stamps ourselves. I am not sure my husband knows I have shares in the post office now, but I think he would whole-heartedly support it, and he supports what I am doing!

The DOS after consulting with attorneys and the Congress has concluded that EB visa numbers should spill over horizontally rather than vertically. Relevent legal clauses addressing this issue were posted by IV members yesterday. DOS now admits it's previous interpretation of vertical spill over (excess visas going to EB-3 ROW) was wrong. Can it be challenged or reversed?, Of course possible but very unlikely to happen in the near future in the next several months.
All said and done, I'll say vdlrao calculations with (sumagiri correction:) look credible.

I am not negating anyone's personal decision here but after leaving for 10 yrs in US and still not having a GC makes me wonder why I should go to canada rather I would go to india and live there where we spent our 25 yrs or so and be part of the community etc.

I had been there in US for 7 yrs (3 yrs in L2->1yr out of US->4 Yrs in H1B). Saw the myths and tragedy of US GC process very closely. Didn't want to spoil peace of life and my hard earned money with USCIS and lawyers:mad:. Didn’t look at the US GC application and applied for Canadian PR. Came to Canada with PR last year from US. Peacefully settled in Toronto with nice job and benefits, bought my brand new car 4 months back. Nice and friendly people and government. Happy to be in Canada. No more stamping issues, tons of junk paper works, consulate visit PA and wired look from immigration officers at POE…. enough…. I am not going back to US even for a visit in next 5 yrs..…
But I can go out of Canada and enter any time and as many time as I want. Can you do that too???? :D
To those who are portraying wrong picture of Canada, all I can say, if you have skills, personality and capability, you’ll succeed anywhere in this world, be it in US, Canada or Australia. Don’t blame it on a country, but look at yourself.

I also came to Toronto in 2007. I was a F1->H1B tired of the H1B dance through stamping,
body shopper etc. I came in 2007, did MBA at U of T....doing well now. Yes Canada is tough job market but eventually it is working out....but hey US under H1B is tougher and worse. I never regret the decision. If I have to take the decision again, I will take the same decision.
One thing for sure...I am definitely better than US H1B mess, changing place to place like nomads for projects and yes better than the 1.5 typical travel to work on jammed roads in India or hour long travel in Mumbai locals.
I think of working in US in future but never under the mess of H1B body shopper. I will try TN1 visa (now 3 years). I am not against working on H1B but not under the desperate terms that one has to typically do if one has Indian passport. The way i see is that skilled immigration to US is over under Eb2-I/Eb3-I. A lot of people have yet to accept the reality.
But I can go out of Canada and enter any time and as many time as I want. Can you do that too???? :D

Not sure I follow you. How are we getting 50K spill over visas?
I already mentioned in my previous posts (multiple posts with same matter for people like you and me, see it and understand it well) how we are getting more than 50k visas just for EB2 India. I am giving it here again the visa allotments for 2006 and 2007 years when theres vertical fallouts. Now its changed to horizontal fall outs.
Due to this as many of us think its not the EB3 India which is losing, but its EB3 ROW.
Class --------------------------------------> 2006 | 2007
Total Employment-based Approvals ----------> 159,081 | 162,176
EB1 ---------------------------------------> 36,960 | 26,697
EB2 ---------------------------------------> 21,911 | 44,162
EB3 ---------------------------------------> 89,922 | 85,030
Fourth:-------------------------------------> 9,539 | 5,481
Fifth (investors) ----------------------------> 749 | 806
See the Total Employment Based Visa approvals for 2006 and 2007 159,081 and 162,176. But there are only 140,000 visas in EB category. The rest of the visas came from Family Based visas which are not used for the previous fiscal year. The share for each category: Each EB1, EB2 and EB3 should get 1/3 of 140,000 = 46,666. But due to the less demand in EB1 and EB2 ROW all the visas falling to EB3 ROW due to the Vertical falling.
EB1 ROW --> EB2 ROW --> EB3 ROW.
EB1 INDIA --> EB2 INDIA --> EB3 INDIA.
As theres not much demand for EB1 ROW and EB2 ROW, all the unused visas are going to fall to EB3 ROW. So from this time its going to be like Horizotal fall out like below.
EB1 ROW/EB1 INDIA --> EB2 ROW/ EB2India/ EB2China-->EB3ROW/EB3 INDIA.
So this time to fall any VISAS into EB3 ROW they have to pass through EB2 India/EB2 China. So this makes EB3 ROW dates would retrogress due to the decrease in visa numbers availabilty.
As I said each category would have 46,666. So EB1 and EB2 together will have around 93,332 visas. But in EB1+EB2 in 2006 about 50,000 visas approved and in 2007 about 70,000 visas approved. So for 2008 also asume the demand for EB1 and EB2 is 70,000. But the availability of VISAS are 93,332 as said above + unused family visas which come around 19,000+.
So for this 2008 fiscal year for EB2 India and China the total visa numbers availlable are
(93,332 +19,000) - 70,000 = 42,332.
So around 42 thousand + 9,800 (regular 7% of 140k) = around 52k Visas Just for India , because EB2 China was already Jan 2006 a year back. And I dont think it would take any considerable share in this 50k other than its regular 9,800 visas.
Get me back if you have any doubts.

Peacefully settled in Toronto with nice job and benefits, bought my brand new car 4 months back. Nice and friendly people and government. Happy to be in Canada. No more stamping issues, tons of junk paper works, consulate visit PA and wired look from immigration officers at POE…. enough…. I am not going back to US even for a visit in next 5 yrs..…
But I can go out of Canada and enter any time and as many time as I want. Can you do that too???? :D
To those who are portraying wrong picture of Canada, all I can say, if you have skills, personality and capability, you’ll succeed anywhere in this world, be it in US, Canada or Australia. Don’t blame it on a country, but look at yourself.

Translation: One need to be proactive and join IV at earlier visits rather wait and join when something goes wrong!
