My employer(hospital)filed for the PERM processing and paid the fees for it.It was subsequently approved with an audit.I filed for the I-140 in May 2008.The lawyer who was recommended by the employer did not give me the receipt number,nor the receipt.I was just told that it is pending approval.What are other people's experiences do you usually get a copy of the receipt?I was expecting to get it as I paid for the I-140 filing?I just want it so that I can keep tracking it on the uscis website.

I understand that cross chargeability becomes valid at the time of allocation of the visa number. So what do you mean by "in advance"?

Yes I got it for my daughter. The CGNY website lists all the documents required. I sent
only the photo-copies of all the documents they mentioned, each page notarized.
I got PIO card in exactly a week and I live in North west Ohio close to MI border.

Hello,
Here is my situation.
Status : H1B Visa
GC Status : I-140 Approved in EB3
Priority Date : May 2004
Years on H1B: 9 years
H1B Expire date: 01/2012
Please advice if i can change my employer now or it will be too risky. I was hoping to accept new positions if new employer is willing to sponsor a h1b and green card from begining. So i can retain my previous PD.

You will be out-ofstatus. And you need to find a job before 30-day grace period (it depends on the person who is handling your case) and move back to H1. Otherwise you cab either change to a different visa category if possible else you have to find a job and get your H1 through consular processing which happens to visit your home country get the visa stamped and comeback to US.
I am not sure about your previous H1B. if they have revoke your h1 then you cant do anything.
This is my opinion. But you can wait what others to say about this.

Hello.
I have lived 6 yrs here & became a U.S. Citizen last Sept. 2010. Last February 2011 i was diagnosed of Breast Cancer. It's been pretty rough living alone without any relatives around. My husband works oversea and he travels frequently, he can't change his job right now, this will be the source of our income to support my health situation. In the next two months my doctor told me to do another surgery on my breast. I did fine with my first surgery as my husband stay home for a couple of weeks while waiting his next project. I'am thinking if it possible for me to petition my knee to live with me in the U.S. as i will need a assistance with all therapy and with my 11 yr. daughter. I am from the Philippines.
Please advice.

Hi,
My first NIW/I140 was concurrent filed with I485 for both my wife and me. When they denied I140, the USCIS also denied I485s for both of us. I have a pending MTR for that I140.
I then filed another NIW/I140, which was approved. Surprisingly, and I just noticed that, the approval notice has the A# that was on the I485 of the first petition.
So, should I assume that my the USCIS has interfiled my I485 automatically and my old PD is active?
If yes, 1) Is there a way to confirm this, and 2) do I still have to file MTR for the my I485 that was denied, and 3) Since it has been 6 months since the PD, am I eligible for EAD under AC21?
Also, what will happen with my wife�s I485? Since the original I485 was denied, will interfiling be okay or should we MTR it?

Friends I need an opinion regarding my wifes situation. She is currently on H4. She was on H1B before some time back which she had stamped in India itself. That H1B expired. She moved back to India. After 5 years now she applied for new H1B and got it in the quota. When the dates advanced we applied for her EAD. We were hoping to get it in 60-70 days. Now its been 75 days at TSC and no signs of approval. She had job offer based on EAD since we thought might as well use that. Now we are thinking she should get her H1B stamped because we dont know when her EAD will get approved. For that do you think going to Canada for stamping is safe. She has a Bachelors degree from India. Or do you think going to India only is thesafe option. Mainly I asked was I did some search and found out that its safest in Canada if you have US/Canadian Degree. Is that true or I am wrong and its safe for everyone. Thanks.

My PD is Dec-04 and I-485 filing date is Sept-07.
I changed my job in Aug-2008 and discontinued my H1B which is expired in Sept-2008. Now my only legal status is 'adjustment of status from H1B to Permanent Resident'. I think this is very common state most of the people waiting looong for GC fall into.
Now, I saw one of my friend's i-485 denied (with NO option to reopen!) bcoz an approved I-140 was not attached to this application. I agree that this is not simple mistake for USCIS can ignore, but there is always a 'very very remote' possibility that every application can be quetioned due to some flows in the filing.
Here is my question: Since I discontinued my H1B status and I am still in this country, can I apply for a fresh H1B? I am thinking because H1B quota is still open this year and to face any unexpected reason for 485 denial!

All i-140 apps will go to Nebraska. Then they will distribute randomly between NEB and TEXAS.
