so i understand how the whole 7% thing works now in relation to the total visa's available....
but what i dont get it the fact that EB3 ROW was at Aug 02 in april this year,
then in May it moved to AUG 03, so people were clearly getting through the system....
then in June it moved to June 05 so again in that month people where getting processed, and moving through the system....
then the July fiaco, i guess because they were running tight for visa numbers...ok water under the bridge.....
But now the Oct bullitin which is the start of the new fiscal year puts us back to AUG 02 again........how does that work??? i dont get it. how can they suddenly be dealing with people from 02 when even in May it was up to AUG 03???
I would have thought that with the start of a new fisacl year there would be a full fresh batch of numbers, and people would get through a bit quicker for a least a couple of months...you would have thought that it would be current for the first month on the new allotment....wouldnt you???

People with EB3-India may not expect any kind of fast movement in near future, unless law changes. It will be in snail phase. It is waste discussion to analyze howmany people filled EB3 LC from India in 2002,2003 etc. Generally EB3 is very high demand catagory from all accross the world. EB3 contains skilled worker catagory including cooks, nurses, and so many many non-professional occupations. All the discusion are focussed on demand by Indian IT folks, by ignoring other spectrum of the demand by other group of peoples. Therfore no matter what; EB3-India will get only 3000 EB3 GC per year (Approxmatly 1500 primary).
1500 LC per year EB3 India is a tiny fraction of the demand by EB3 India. Therefore best advise in EB3 India folks to convert into EB2 to get use of early PD like 2002 or 2003.
Only when EB3 ROW becomes C can EB3 China, India & mexico see a leap in priority dates. March bulletin 08 pushed EB3 ROW by 2 years. Apr bulletin pushed it by another 6 months to Jul05. How can you say there is no stress for the person working at home, raising the family?
The poor H1 soul is constantly over-stressed as he is supporting a spouse and a child or even two children.
Imagine how the H4 spouse feels...he/she cannot do a thing to alleviate frustrations of his loved ones as her hands are tied..
I deeply care for my husband and I had lived through some agonizing days in the past when he was out of work, without salary etc..knowing how much he is in pain himself as everyone and everything depends on him, literaly....
We will be moving away soon 'cause we care too much for each other's happines to continue to live in the circumstances where we only suffer ...
I second you on that.But we must keep in mind,we know the law before coming here .Every immigration lawyer wants H4 law to be changed but, you know "USCIS".. they have handsfulll.

Thanks for posting 2007 cloture vote. So 53 senators voted in favor of 2007 CIR cloture. If even half of the following 15 Democratic Senators (who voted against the cloture vote) would have voted in favor of 2007 CIR, the bill would have passed the cloture vote, right?

You came here 6 years ago and applied for your GC only in 2010. Didnt you find an employer who would file one for you. And you also know if your GC gets screwed for some reason, then you are out of the US also.

They are all corrupt and they are all actors. I am talking about all politicians, in this or any other country. They are not leaders, they are all politicians.
Republicans project themselves as pro-business that is expected to create more jobs for Americans. They support legal skill immigrants not because legal immigrants are "beautiful", but because legal immigrants help big-business make more money. For republicans this is not the question of pro or anti immigration, it is primarily 'wealth creation' issue for big-business. Republicans usually do not support provisions for employee protection as it hurts the agenda of big-business.
Don't get me started about Democrats who are no different. Its just that Democrats don't care about skilled immigrants at all and they only care about big business during fund raisers.
Even Bush was not able to push Republicans to support CIR. McCain was forced to disavow his support for CIR just to win the nomination.
Bush did what he could to push for CIR. If all Democrats would have supported, CIR would have passed in 2006. In 2007, if it was not for blue dog democrats, CIR would have passed in 2007. But democrats had decided to set their priority for not forcing their congressmen/women to go through a difficult vote which may possibly make Democrats lose the election in 2008.
On the other hand, it was always at the time of a Democrat President when immigrants had freedoms. VB was almost always current. You can get driver's license easily.
Difficult with DL is primarily due to the fallout of 9/11, it is not because of a democratic or republican president in office.

Most legal immigration bills were passed/worked upon by Republicans including AC21 bill. Not because republicans are pro-immigrants and democrats are anti-immigrants, but the reason is republicans are supposedly pro-business.

They are all actors and each individual lawmaker decide their position based on how it would effect their re-election. If I were you, I would make it clear to the employer that you qualify for tier 1 in UK and educate them on benefits of tier 1 vs waiting for green card then go from there. It worked for me.
My plan was to see if I can upgrade to EB2 with the same employer. My attorney just shut my hopes down this afternoon. Per my attorney, the job description has to differ by atleast 50% if I were upgrade from EB3 to EB2 with the same employer. I guess it is hard to prove that Principal Software Engineer's job description and Software Engineer's job descriptions differ that much.
At this point I have not other option but to wait it out. I cannot move to a new employer and refile in EB2 because of valid reasons.

Piyushpan, you are restating what I said and putting in extra things. All 3 categories need an immigrant petition. The advanced STEM degree + 3 years people need "special labor cert" if their grad degrees are not from the US. Please re-read what I wrote earlier.
Are you STEM exempt? if so, is your advanced degree from the US? If yes, you may not need labor cert. But remember, I am not an expert. Get a lawyer's advice.

1 People who have advanced degrees and are presently working can apply for adjustment of status(I-485) even if they don;t have a labor or a pending I-140 but they will be subject to quota to get the final approval.
2Secondly for people who are presently studying and doing their MS they can directly apply for I-485 if they have a US job offer within one year after graduation but they will be subject to quota as well
3Thirdly there is the category which has MS/Phd and 3 yrs of related exp.
For this category they can directly apply for I-485 and no quota issues either.

You have to understand the simple fact that no,law or system is 100% perfect on day 1. Over time we have to learn the system and take the feedback and modify the system according to changing times. You cannot say that discrimination is built into the law. This is totally wrong.
Again H1-B visa is a privillege just like Driver license. It is not a right.
We can only request/protest democratically following proper protocols and get our things done. Otherwise there won't be any difference between us and those terrorists who protest by suicide bombers.

Few months back I was frustrated and was seriously considering going back to India. Until I had to visit Denver for some work last week (where I use to work before). I met one of my freind who is from India and after listening to his story I decided may be it worth waiting for GC. He never wanted to stay in US (not because of GC retrogression but for other reason) and on advise from his coworker he applied for GC. He got his GC in one and half year (wow !! great isnt it). Now look at the life style he is living beautiful house by the lake with view of mountains kids going to good school. He comes home for lunch, work is just couple of miles from home. Huge shopping malls at stone throw distance. Now he thank his ex-coworker for his advise as he and his family is living a wonderful life.
Its just matter of time. Lets look at the glass half filled rather than half empty few months back it was total darkness atleast now we have bills passed by Senate which incorporates IV goals (kudos to IV core and all members). All we can do is try as we did before. Lets renew our fight with full vigor we are half way through. Once it passes HR we are done. I urge all members to participate on Sunday's conference and plan new strategy.

H4 - must be allowed to work. American economy does not differenciate between an American and a legal alien. We all pay the same rent, same tax, same price for car. When our H4 spouses cannot work, we have to totally depend on one salary. In case of emergencies we hit rock bottom economically. Quite obviously our quality of life is compromised.
