    A lot of people continue to debate with each other, accuse IV, say all kinds of nasty things that makes us sometimes question why we are working so hard for this cause. Our own people can be our worst enemies. But when you read the stories of harship, struggle and problems faced by members within our community you feel the need to work harder and give your best to this effort. It is a waste of our time and energy to douse fires everyday. There is strength in unity and collective effort.

    While we are busy amongst ourselves, anti-immigrats are having party time seeing our state of affairs and they are working overtime to make us unsuccessful. They visited our forum today and saw the article published by our member in media and went to its site and trashed the member of our community. I feel we must try to protect each and every member of our community and this organization in order to bring everyone closer and feel comforted in the outside world where we have enough anti-immigrants hellbent on defeating us.

    More than 7 hours have passed and not a single member has written a note opposing the views of the anti-immigrant group that works against us. The reason for not taking part in anything outside this forum is very clear. It is because we are more worried about getting updates, where $20 are going, criticising our own community members and sometimes criticising IV.

    Do go here and post some hard hitting arguements to shut up Kim Berry

    I sent my EAD paper file on 29th May to TSC. I received my EAD's today for 1 year. Cutoff date for 2 year is 30th june.

    The H1B visa belongs, in effect, to the company that sponsors it. You cannot work for any other company on that visa other than sponsor. If this is a transfer, then, In a so-called "visa transfer" what actually happens is that the initial visa is cancelled in favor of another one issued for the new employer. What that means is OP's work with old employer is considered as "unauthorized work". Do not consider this as illegal presence, as his legal presence is controlled by a valid I-94.

    This is incorrect (highlighted in Blue above). Just because new H-1B petition is approved, old I-797 is not canceled. Again, gapala, understand this, if old I-797 is not canceled, beneficiary is authorized to work for old employer for I-797 validity dates. Unless, Employer request to cancel H-1B petition, employee can come back to work for that employer even after starting working for Employer B.

    Gapala - One more time, during the validity dates of I-797, employee working for old employer is not "unauthorized work". OP was authorized to work for "Employer 2".

    If its a transfer, your I-94 "number" will be same. Check to see if you have same I-94 number on any or all or atleast 2 of your I-94's including the one which they provided you at POE "across" any of your employers (1, 2 and X).

    As I stated beore, matching I-94 number does not mean much. I-94 number will be same for cases of change of status from, say, H-1B to B1. On the other hand, I-94 number could be different for H-1B transfer.

    Gapala - I have noted that you provide lot of incorrect info in your posts. Please be careful in what you write.

    I do not see anywhere in the legislation where it says that EB1 is "more skilled and valuable" that EB2 and so on. What it does say is that the various categories require a certain amount of education and hence my point! I am not insecure but I AM frustrated at your arrogance. Look before you leap and read the Immigration Act!!!!

    You betray your own post .... forget the INA .... all you have to do is read the visa bulletin ... read just the 1st page.... thats all you have to do ...
    The Employment categories are basically termed as "EMPLOYMENT-BASED PREFERENCES"

    Surely you must be intelligent enough to reach the same conclusion regarding USCIS preferences regarding categories that I did.

For example, there is no 'explicit' prohibition against issuing employment authorization to spouses of H1bi employees. The rule-making agency (in this case the DHS or USCIS) can grant a benefit that spouses be provided with employment authorization. Recently, the USCIS actually did provide regulatory relief by de-coupling the H1bi period of stay from the period of stay in H4 status. An idea to consider...

    This is a very common problem. They are not following their own rules when it comes to 180 day rule of I-140 revocation. And I have heard AC21 letter almost never reaches your file. But because you have filed AC21 , you are in good shape. You have all the proof that you did send the AC21 letter and I-140 was revoked after 180 days.

    So you will be able to open this case using MTR. Do not worry , you just need good lawyer to represent you.

And, since I suspect this is part of the problem look up "hypothetical". The correct term should have been "on or after July 2" not "after July 2".     They did a good job. My only complaint with they kept changing the paralegal that was handling my case like 3 times during the whole process. Otherwise no problmems.



    First thanks to those who put there first hand experience in this thread, it made me think again. And now I am deciding to cross the border and go north, after 9+ years in US on H1b.

    Could someone please refer a Do-it-yourself kit that they have used and/or immigration consultant?
    I contacted one consultant, they email almost every week and when I called/emailed them saying I am ready to pursue there has been no response from other side yet.

    It will be great help for me if you could refer a kit or a consultant.

    Looking forward to join H1->Canada community :D

    , if they were EB2 candidates why they didnt file on EB2 category at first, if now they think they are qualified then they should start new process.

    BTW. they will create a big retrogression for EB2 then EB2 people have to port to EB3



    In many cases the question is NOT about qualification of the applicant but the policy of the company -- lump all in EB3 so that the employee stick to company endlessly. If you think porting is unfair, Citizens and LPRs think H1B and entire EB GC process is unfair ...

    Disclaimer: I have Never filed in EB3 . My first and only filing is in EB2.

    When I disucss such issues among my Indian friends - people discuss it for sometime and move on to the next topic. if I try to convince people about the seriousness and how everyone should feel bad about it and do something aboout it - all I get from them is "Relax and chill, life goes on - these guys will get some apology"

    A lot of Indians are also not vocal about the issues they face. They just absorb it and digest it and pretend as if nothing happened.

    If I discuss the samme with non Indian - they will say "You guys must all do something together and stand up against this - I can support you if you all stand up"

    All I see is only non Indian support - no Indian standing up.
