My current employer told me 2 days ago that he will lay me off. It hit me out of nowhere cause there were no signs pr signals. I dont know how much time he will give me to find a new job. So, here are my questions?
How much time do I have legally to find a new job and to get the visa transferred?
Which forms has the new company to file and how much gonna be the fees?
Is premium processing possible?
Can I start working for a non-for-profit organization?

I am with Company A and my current H1 expires on Nov 2009. I got an offer from Company B and they are insisting to Join with H1B Transfer Receipt ( and not on getting I-797 Approval). Please let me know the following:
1. Can I join Comapny B with H1B transfer Receipt, can Comapany A create any issue here (like if comapany A cancels H1 Visa after I get receipt from Company B)
2. After I join Comapny B with H1B Receipt , and I get 1 payslip from Company B , Can I go to India and Come back to US with Visa Stamped (from Company A) and H1B Transfer Receipt from Company B ( Note I still may not have I-797 Approval Notice)

This is confusing. In that case how do they make ROW current or PDs way ahead of India? In other words, how do they know without touching a file that PD of a ROW file is current and is eligible to get GC!
Think about the flip side. If this is true, then once they preadjuridict all cases, thousands of ROW cases will immediately become eligible to get GC and India / China will not move for year(s)!

My I-140 was filed on July 6 and arrives at USCIS on July 9.
The check was cashed on July 12 and I was able to get the receipt number. BUT BY NOW I HAVE NOT RECEIVE THE RECEIPT. It seems many people are in the same boat. What we can do about it?
Anybody knows how many days it would take between they cash the check and mail out the receipt? What address do they use?

I am on call with USCIS now. Press 1-2-3-6 and immediately agent would face to you by giving agent ID. Currently I am listening the music. She has just gone somewhere to have answers:mad:

1) It does not matter what expenses you had to bourne, USCIS is not simply
accepting applications till October 2007.
2) My next Question was: What would be the probability of my PD become current at October 2007, Ans: we can not predict at this time:(
3) Next Q: If my PD does not become current for one year from now then would USCIS consider releasing any help or policy to pay back the medical expense and expense for my travelling back from India?

PD Nov 2001 - Nov 2002 -> I would say no point in switching to EB2.
Labour + 140 will take atleast 12 months and another 6-9K US$. Not worth it because even otherwise you might have your GC within 12-25 montha from now.
PD Nov 2002 and beyond : Have to actively consider switching to EB2. Myself being in this range, I am doing the leg work and waiting to hear on what happens to the recapture bill. If it does not happen then these PD's should switch if they can and qualify.
Instead of being jealous towards EB2 bonanza , I think EB3 applicants should make use of this Eb3->EB2 conversion option and participate in the bonanza.
Yes, it costs additional 9K . Consider that the price of the ill advised decision to go in for Eb3 to begin with.
An opportunity to get past this GC mess and start realizing your dreams on both personal and professional front.

60 Euros. Same price as a short term Schengen visa. So if you can get a short term Schengen visa (the consulates are empty in the US FYI) visit some places in Europe as part of a layover (ironically cheaper to get 2 tickets instead of a transfer) and then travel to India. Skip duty free in Europe as it's price gouging.

I have a last pay check through an Employer A of August 1, 2008. Earlier before leaving Employer A I filed a H1 transfer to a new employer B and that got approved by USCIS but I didn't start working with Employer B. Now I am getting a new offer from Employer C which is better than Employer B. Attorney of Employer C says that he can file for a transfer through company A as the pay check is less than two weeks.
Now my problem is I not sure whether my transfer from A to C would be successfull or not?
Another thing I have not informed Employer B that I will not be joining him, Do I have to pay him all the H1 transfer fees?

There are total 27 EB3-I approvals on since Oct'2008. In 6 months, only 27 approvals is not a good number.
Does anybody know why USCIS is not touching EB3-I aggressively and are we close to using all EB3-I for this year already?

Yes 27 EB3-I approvals seems pretty low. Hopefully DOS would move EB3-I cut off date in May.
