The country cap does make perfect sense for Family Immigration, you want a good mix of culture in the country.
BUT for Skill based immigration it makes no sense. It should be based on skill/qualification and NOT on country of birth. It is very similar to Indian caste based quota system, your piece of pie calculates right when you were born!
I do not agree with this country quota and hence $1k for LS from me, Pledged!
Of course, if successful it may/may not make much difference because of other retrogressed countries with long queue but cause is what makes the call.

If a group is thinking about LS for USCIS inefficiencies between 2002-2004 and unused visa recapture, I pledge another $1k for the LS. If I remember correctly, Mark Bartosik was planning for such LS but in middle he got his GC, if someone still thinks along the same line, I would be happy to join.

I think I-485 filing clause is needed. Please note that the USCIS is not staffed enough. So there is a high possibility that the priority date retrogression will continue even if all the current provisions included in the Frist bill is passed. They will retain the retrogression in order to control the number of applications. In such a scenario, it is important for us to try and introduce the I-485 clause, so that people could get their EAD while they wait for USCIS to clear the mess. My 2 cents.

I just got off the phone with some lawyers on this. It looks like a strong case so far. They will be discussing it with their director and possibly getting some other law firms or organizations involved. That is all I can say for now. I will update you when I know more.

AILA now feels defeated because they could not show themselves as the protector of this community. If you see the lawsuit text by AILF, it clearly asks for money for lawyer fees, but does not asks for moeny for Medical exam and mental agony. So if you are going to trust your lawyers to help you, then good luck.
By the way, your Indian lawyer I dont know the name, sued DOL once and lost.

Why file a lawsuit seeking injunctive relief to allow plaintiffs to file and at the same time demand reimbursement of medical fees and compensation for mental agony (I doubt if there were any plaintiffs put on anti-depressants or therapy in those two weeks as a result of the decision). You can't have your cake and eat it, you either win the case to enable filing, or you sue for damages incurred as a result of the decision but then you have to forget about contesting the ability to file, I'm sure any sane individual will be glad to choose the former and in this case thats what the lawsuit reflects. If you have ever read any class action lawsuit, the lawyers always ask for costs of the suit, this is normal even in non class action lawsuits, the loosing party pays the prevailing party's costs!
In the prior lawsuit that was lost, it is clear that Rajiv said recently that such cases against the executive branch of government need to filed in other federal court circuits other than the DC one where it is likely they will not be inclined to frown when deciding against the executive. For the record, his lawsuit was not against the DOL.

No doubt if you have the time, money and opportunity and if you plan to do your masters or your second masters at some point in future, then right now is the time to do it while you are waiting for your GC.

1. You should have the money to study and maintain yourself/family.
2. Need to have school of decent choice where you live.
3. Need to have a job at same location. Consultants cant have that as they move around from one project to another. You cant change colleges and transfer credits every 6 months as you move from one project to another. Same goes for consultants who are travelling all the time. They cannot do this unless to quit and go fulltime, in which case, the spouse would have to start working to pay the bills and put food on the table.
And what about people who DONT want to do MBA/MS and just want to change employers?
So while a good option, it applies to very few people. If you are one of those few guys, then by all means, go for it.

Here are my observations:
* Fragommen, National - if you sre shelling dough out of your pocket, stay away from them. They are a corporate law firm & if your case gets into a mess, you'll end up paying by the hour. Their rates are higher and you will not get personal attention
* Greenberg Traurig, National - Dealt with them at a corporate level. Their team from DC did not have answers to some complicated situations that we had in our organization
* Murthy, MD - Sheela is good. She is aggressive and creative but they don't pay attention to detail and have good churn in their staff. Take into account you will not deal with Sheela herself on a day to day basis, so no point going to her firm
* Thomas Fan, MD - dude is in Baltimore. Avoid his firm like the plague. I know at least 2 cases where this guy has screwed things up bigtime AND washed his hands off the mess he created. These 2 cases eventually moved on to other firms & were successful
* Ellen Krengel, CA - Ellen is certified to practice in IL but lives and works in CA. Very approachable, empathetic, she will research things for you and keep you plugged into the situation. Relatively junior attorney but is commited to the cause
* Gowda, MI - Similar situation to Murthy. Firm's day to day work load is taken care of by junior attorneys not Gowda.

They hushed up and approved my EAD in 20 days. Why ???? 'cos So they don't hit Jun'30 and give 2 years. They wanted to milk another 680 from me so they hushed up and sent me the 1 year EAD in 20 days.
Well.. :) Look at it from the positive side. It may also mean that your I-485 application is going to take less than a year to approve. (According to USCIS, 2-year EADs are going to be issued only to applicant whose I-485 approval is expected to take a very long time, e.g. more than a year.)

Due to family constrains I might be taking some breaks in future which I think I can do with EAD(but not sure :confused:) and on pending I-485 ( I am the dependent of the Primary applicant of the GC).
On H1 I know for sure I cannot take this break for even 3 months without pay stubs. So I was working hard without breaks on H1.
But once I am on EAD status Am I allowed to take breaks between the contract jobs.
So My question is... Can a dependent of a primary applicant on an EAD, AOS pending status allowed to take breaks between jobs?

I have had good experience with Wayne Chapple Law Firm in Hartford CT. I am dealing with Attorney Taras, and he has been extremely prompt and has responded to all my queries/ update request in a very timely fashion, despite the fact that my employer paid for all the processes. They have handled my case from H1 to GC...I would definitely recommend him!
