    Is that an issue ?

    I see that there is a lack of understanding about what "special" labor cert means.In the context of univ profs it means that the university is allowed to justify hiring an alien based on the fact that he was the BEST qualified candidate for the postion - that is, the univ is allowed to reject other minimally qualified applicants. This is currently not the case for other junta in either EB-2 or EB-3 .. if ANY minimally qualified american citizen / PR is found, the labor cert is denied.

    If this is extended to EB2 / people with advanced STEM degrees as Frist Bill proposes, the labor cert will become quicker and painless for these folks (not to mention the immigration attorneys and the employers).

    It is way more complex than that. Graf was literally abandoned by the GOP, no money at all. The GOP even came up supporting a GOP candidate on their own against Graf. I don't think your conclusion is correct, because Hastert, Sensebrenner, Tom Tancredo and many others against CIR won by large margins.

    From what I have been reading, conservative voters want to punish the GOP exactly to teach them a lesson and make them more active from now on.

    I think for those who can benefit from the amnesty bills, it is time to celebrate !! Hurray !



    Looks like the Leadership of the house is changing.
    Interestingly I heard one of the republican commentators comment that whatever happens, including if the republicans lose there will be a change in the house minority republican leadership, he was putting forward people like Pence and Shadegg as the new leaders(they have been pro SKIL bill). In other words, No Hastert, No Sensenbrenner etc in the committees.
    Interestingly in the districts that republicans ran anti-immigrant platform, they lost badly. One of the bellweathers districts for that in Arizona, Candidate Graf(who got the republican nomination by his very hard anti illegal immigration platform) lost heavily to a democrat who is pro CIR. There are many more such examples (Sen. Santorum is another example). Thse results bode well for legislation as long as the issue comes up for debate again in this congressional year.
    Who knows, now the house republicans might even be willing to consider it in the lame duck session, as atleast they will get to have some say in it. Will be interesting in the next few months.

    I left it empty last time. It was approved. The only question I answered in Part 7 was "how many trips do you intend to use...".....I said multiple.

    in part 7 of the application --> can it be left empty???

    since we r expecting to AP approval to arrive by mail to our mailing address, can we leave this question 3 on page3/part 7 EMPTY?

    As per the last revised visa bulletin, the extension period for filling I-485 is Aug 17. But it talks about only I485 and not about I-140.

    So can anyone confirm, if one can file I-140 and I-485 concurrently from Aug 1 to Aug 17.

Who knows what will happen in future about immigration.. I just read that the senate is planning to come up with a commission that will control the legal immigrant limits...

    It is all the more important to meet and let the senators know what we are going through so that they may think properly for the future.

    I have been laid off yesterday. My employment ends Dec.
    My 180 days expire Jan. My company said they will not revoke the I-140.

    So can anyone explain the steps that needs to be taken by company B after they transfer my h1, for time period Dec thru Jan.

    Can I use ac21 afterwards? and

    Can myself or my wife work on the EAD that will come to our home address?.

    What else needs to be done by company B.

    Will we just get our green card in email.

    If a query comes should I prove that I'm employed with the former company or is it to sufficient to show employment with similar position alone?

    In short if the former company does not revoke I-140 and I take care of the status thru H1b transfer for the 1 month to hit 180 days, will I need to reapply for the GC?

    Please advice to what you think is right based on your best knowledge.


    you need to hope and pray no query for EVL comes until 180 days past your filing of 485. After that if you get a query you can show company Bs letter. the job in B needs to be in the same or similar position.

    It 'll not be in 2004 file ..check 2007 - when your Labor got approved.

    To the best of my knowledge the 2007 file contains only PERM cases. There are no BEC or Pre-PERM cases in any MDB file dated 2005 or later. The files seem to be organized based on PD and not approval date. I still dont find my labor. I am the only GC applicant from my company and my position is a non-IT position so it should be relatively easy to find.

    I am not sure whether it is my HR to be blamed or my corporate law firm TheChugh who has been handling my case, no one has bothered to convey my PERM status or even my case #. I feel frustrated when my HR doesn't respond about the status.
    I understand that they must by flooded with application preparation but setting up a link for me to check the status shouldn't be very difficult.
    I really hope that my PERM gets approved before 31st July so that I can file I-140 and I-485 concurrently.
    Anyone else has experience to share about TheChugh law firm?

    It was the figure that the Kauffman Report found about a month ago when studying the potential for Reverse Brain Drain amongst other things. It as accurate a number that you will find.

    Remember, this is many years of cumulative build up of temporary work visas transferring to permanent residency path

    A total of 2.5M cases pending (AOS and naturalization), only 1.2M are ready for action.

    1.3M backlogged cases TOTAL (includes naturalization), out of which more than 800K are retrogresed family-based AOS petitions, and what looks like 30K EB petitions (cannot be approved due to statutory limits). 300K cases in namecheck, maybe 10% of them are EB (EB is about 13% of green cards), so we are having about 60K truly backloged EB cases in March 2007.

    We know that cases that are current and not stuck in FBI checks are being approved farily fast, so my gut feeling is they have maybe 50-80K EB cases in active adjudication. Let's double-check -- out of 1.2 million cases ready for action, about a half is naturalization, and from the other half, ~13% would be EB - yep, 80K (EBs are the easiest to approve because there are no interviews or tests, so the percentage is likely less than 13%).

    So, in March 2007 there were a total of no more than 140K pending cases in I-485 stage of stocessing. Now in June-August EVERYONE who had an approved LC got to apply, and there were ~300K applications, while CIS gave out ~70K green cards, so we would have a total of 370K pending petitions. This estimate is surprisingly close to 13% of the total 2.5M backlog, so I would consider it good.

    Again, I absolutely do not believe there are more than 500K EB1-EB3 cases. There may be another 500K in the 'other worker' category, but this is not what we are talking about here.

    In my opinion, with this global economy - if the spouse is well educated and can work, there should be an opportunity for that person to work (atleast few hours per day).

    Sitting at home and taking care of kids for long, can drive a capable/educated individual to psychological issues, which can overall have an impact on family as well as the mental wellbeing of the breadwinner.

    What happened to all those Equal rights for women/dependents etc etc groups in the US? Ofcourse I am not saying that all H4 people are women (the majority is women)

    All I heard is something like below. I am not sure what I heard is correct.

    1. Bes tway to take 401K out is to rollover the 401K into Roth IRA and then withdraw from the account after 5 years. You can save lot on taxes.

    2. For all H1b holders, there is a form which you can fill and submit to IRS which says you want to get all the SSN money back. But once you fill out this form and get the money back, you SHOULD NEVER enter US for any reason. I do not know what the form is.
