I must say that this is a great great effort. Both, the flower campaign and the rally. Nothing like this has been done before by wanna-be immigrants. We are hardworking, law abiding, well educated people. But until now, the general opinion was that we are at the mercy of the American immigration system. I was especially so frustrated when some of my friends thought that there was nothing wrong in what the USCIS did. Their response was simply "what can we do? let's just re-apply when the dates become current again". Historically, Indians (at least, from my experience) have been hesitant to protest against the wrongdoings of their rulers. This is seen even today, when we fear to raise our voice when our bosses or managers at work exploit us, or our advisers/professors exploit us, or if the USCIS changes rules in the middle of the game. In India too, the general opinion is "Nothing is going to change, let's not get into trouble". This rally has shown that things are changing. We all should wake up, and fight for our rights! I could not attend the rally as I am based in Michigan, but I thank all of you who protested for me and my family. I will do my best to support this effort in whatever way I can.

I just thought of starting this thread for people who did not attend. Please explain in one or two sentences why you did not attend. Whether it was a personal reason, whether u were scared, didn't care, forgot, didn't know! etc.
My reason:
I really wanted a green card, but because India is growing so fast, I really don't think I want it so badly anymore. So, I did not have the motivation to go ...
I am honestly curious. What changed in two months? You were desperate then, and you are not now?

When I said that there should be one Item in IV agenda to Ban Porting, everyone got mad.
I still say that they should be allowed to port but should go back in line. they are disturbing the balance. I am not against them, if they were EB2 candidates why they didnt file on EB2 category at first, if now they think they are qualified then they should start new process.
BTW. they will create a big retrogression for EB2 then EB2 people have to port to EB3

If you do some more research before writing you will realize that H1C are limited to 500 visas a year and the conditions for selecting the hospitals allowed to sponsor is so stringent only 14 hospitals or so in all US qualify. Here is some more info.

Many posts on this thread suggest that there is no H1B type visa for nurses and so they have to come on only greencard; and that is why Health lobby is trying hard to GRAB 90K unused visas (note: I consider this as a grab because from skill/CIR bills; we are trying to recapture unused visas and make them available to ALL EB immigrants rather than allocating them to one special group). But according to this news item on immigration-law there seems a non-immigrant visa H1C available for nurses. Is this true? am I misreading this?

The Nursing Relief for Disadvantaged Areas Reauthorization Act of 2005 took effect December 20, 2006. The Act reauthorized the H-1C nonimmigrant nurses program, a program originally created by the Nursing Relief for Disadvantaged Areas Act of 1999. Under this program, eligible hospitals file attestations with the Department of Labor, Office of Foreign Labor Certification which, if approved, will support nonimmigrant worker petitions filed with the Department of Homeland Security, U.S. Citizenship and Immigration Services. The Department of Health and Human Services has informed the Office of Foreign Labor Certification that the same hospitals eligible for the original program continue to be eligible. The Employment and Training Administration, under the authority of the new public law, is reinstating the H-1C labor attestation program and is accepting applications by qualified hospitals. Eligible hospitals should be advised that the now-expired OFLC form (ETA 9081), Attestations by Facilities Temporarily Employing H-1C Nonimmigrant Aliens as Registered Nurses, has not been authorized by the Office of Management and Budget (OMB) for current use. I may not need to tell you this but you are dealing with most greedy, money making machine in US govt. System. This organization churned out 200K EAD last year in 1 week, just so that they don't have to issue 2 years EADs. This org. is rejecting I-485 to get $1000 MTR fees, they will not spare any chance to take money from your pocket. I would say Instead of asking them for the fee waiver and wait 3 months for their 'NO', just give them the 5K and move on...

Well, I've got a few reasons.
1. I don't like the attitude that comes along with the people that speak it.
2. I just don't like the language.
3. I don't live anywhere close to a place where I must know Hindi to survive.
4. The Indian Constitution recognises English as a subsidiary official language.
5. If I have survived as long as I have without knowing Hindi, I'm sure I can survive without knowing Hindi for the rest of my life.

Either u r heavily drunk or u r arguing for the heck of it. Whoz paying for whose free lunch? What proof can u or any of the core IVs show bout July 2nd reversed bulletin? There r hundreds of thousands of ppl who believe that AILA's planned lawsuit was the cause for USCIS' reversal. Agreed! IV's flower campaign made news but action? I doubt it. IV core needs to be transparent and needs to enlighten us with what IV did so as to make USCIS reverse the bulletin if they claim to have done something. If ppl were convinced of IV's actions, there wud have been a flurry of donations so far.

Its very disappointing to me. My some of friends who filed labor just 2 months before me now will go citizenship for next year.
All EB3 who filed their I140/I485 in June and afterwards have to wait till processing date cross at least June. Right now TSC is processing April 2007 cases. I believe when both center starts processing July cases then you can see significant movement in EB3 cases. I think you need to wait till September when new quota comes. Till that time as my Atorney says focus and save your Jobs. Get more skill. Without good job all above is meaning less. Busy yourself in NFL, NBA, NHL or Cricket be cool and calm. Nothing is in your hand except waiting.

Well, one could argue that North Americans have access to the TN visa, which is kind of easier to apply. Similarly, the E visa for Australians as far as I know doesn't allow a dual intent;therefore the H visa still has an advantage over the Australian one.
Am I right ?

Rather than crying for shortage of Manpower they should utilize the talent already present in the country. Has someone every raised this issue with the senate? I dont think so....and I think there is no forum also to take it up.

c. If you are an applicant for adjustment of status, a copy of a USCIS receipt as evidence that you filed the adjustment application;
d. If you are traveling to Canada to apply for an immigrant visa, a copy of the U.S. consular appointment letter.
So what I gather from this is that they need:
a) Our H1B status papers and the previous copies of the advanced parole documents.
b) A letter stating why we need the advanced parole.
c) The I-485 receipt copies.
Now it DOES NOT say anything about the photographs if you are filing within the US.
Can someone who has applied for the Advanced Parole (NOT the EAD), please share their experience and what documents are needed. The EAD filing seems to be elaborately covered.

i am pretty sure, there wont be any fee for next 1 year, for the guys who got 1yr EAD. but, third year u pay again $340 for 2 more years. bottomline,$340 is for 2 years of EAD. otherwise there will another law suit from AILA.
i think the reason for super-quick approval is not that they want milk more money. they must have approved ur EAD before USCIS released formal 2 yr EAD notification. and not many people filed for renewal at that time, due to 120 days rule.
i myself delayed, filing EAD renewal, soon as i heard the news about 2 yr EAD will be effective from Jun30th. :-)
similary, i converted my Apr'07 I-140 to PP on Jun18th,'07 and got it approved on Jun26th,'07, few days before they stopped PP :-)
