Hi,
I am just wondering how USCIS can take the GC card back.
Say for example, I have filed my I-485 and it got approved (with out any regard of whethe my pd is current or not )and a card has been issued. If I take the card for granted and started utilizing it, how am I voilating my status. Isn't this USCIS responsibility to make sure that they issue properly or not. The applicant might never know whether his PD is current or not. In this case how could USCIS can take your card back. If they can, Can't we sue them ?
and my attorney said "If you were to pull up to a ATM and withdraw $100, but for some reason the machine spits out $1000, what do you do?". Well, you can keep the money and drive away or walk into the bank and give the 900 dollars back. But if you are caught of not returing that money latter then that would speak about your wrong intention by itself. So at that point you may be actioned based on whatever law exists. In this case however it is very clear, USCIS can revoke your green card anytime.

Again ... like I said in my post .... It is NOT NOT individual's qualifications or Country that matters, it is the JOB descr they do that decides the EB category. IF USCIS places more value on EB1 than EB2/EB3 category jobs that is not my problem .... but thats the way it is (doesnt mean that it is in anyway right)... and that was my point ..

Simple e.g. I like Target as a store. That doesn't mean I give Target money and let them give me whatever they want for that money. I want to know before hand what my money is getting me.
very true when you are talking about a person who walks into a store. But you are asking for Target's strategic plans, how many stores it will open in the next quarter, what is their marketing plan in regards to Walmart (their main competitor).
Are there any immigration bills that IV supports? What are they? What is IV going to do to get them through? What does IV expect from the lobbyist?

I just want a quarterly report of what IV did with the money it collected and what IV will do with the money it collects in the future. A simple 5 line explanation is enough. It has to be something concrete though. "IV will improve the EB immigration process" is not enough. E.g. "IV will contact all senators in support of XYZ". "IV will make sure there is constant media attention to our problem" etc.

population has become hostile to the whole concept of foreign engineers/IT workers. Companies like Infosys, TCS hire 100% IT staff from India etc.
(saying that no US citizen/GC available...thats like lying in broad daylight)
Nurses came on Green cards and were free to change jobs etc. so
they affected the local job market to a far lesser degree so the opposition
is less.

Hi,
I recd EAD physical card today. My application was approved on 6/27/2008 and I had two LUD on my I-765 Case one on 06/29/2008 and 06/30/2008.
Mine is paper file renewal @NSC Applied on 05/18/2008.
I have one year validity starting from the old expiry date.

I may not need to tell you this but you are dealing with most greedy, money making machine in US govt. System. This organization churned out 200K EAD last year in 1 week, just so that they don't have to issue 2 years EADs. This org. is rejecting I-485 to get $1000 MTR fees, they will not spare any chance to take money from your pocket. I would say Instead of asking them for the fee waiver and wait 3 months for their 'NO', just give them the 5K and move on...

Well...I am one of us stuck in EB3. I do qualify for EB2 but my employer choose to file it under EB3. I recently invoked AC21 and moved over to a new employer on my EAD. Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?
I am in almost exactly the same situation as you... I wonder if this can be done as well... On the other hand, as long as AC21 and EAD are prevalent (as long as we can indeed get 3 yr EAD) it is atleast not as bad for us...
I pity the poor guys who could not file in july for whatever reason and are stuck in EB3 with a later PD

Even if SKIL goes through it'll be Oct- 2007 befire its being actually implemented by USCIS. So you have atleast 15 odd months of wait.

Well this is an unfortunate development nevertheless it brings closure to months and months of speculations and hope for us. For past one year IV has provided as with a forum to fight for a our just cause and brought together all of us like minded individuals. I sincerely thank IV for that and doing countless things beyond what they have signed for. This has been a hard fight full of down moments but all in all it was a worthy experience. I guess we are at a juncture where I get the feeling despite our hard efforts to distinguish ourselves based what we are and what we represent, there is a growing consensus to tie us with what we don't represent. To me giving us what we are asking for, ONLY when they will print 12 million+ Green Cards for people who have falsified identities, carried no driver's license and have fled to America to fight hunger and poverty is an insult to what we have fought hard to achieve in life (education, career etc) in past many years. I have seen numerous stories on IV forum about folks who struggled to renew driver's license at DMV's and that's just tip of the iceberg I can go on about the struggle each one of us has faced to keep legal status amidst recessions, job loss, insanity of DOL, USCIS and many other hurdles. I don't have much to say except that the next step to achieve our goals is a conflicting priority. At this point I feel that there is no need to educate people who choose to be ignorant. I will sign off now !!! I wish good luck to IV and Thank IV core for doing more than what they have signed for.

I have done e-filing for my AP renewal. I read the instructions to see what documentation I need to mail,but I did not find any documentation specifically for e-filing. Does this mean that there is no need to send any documents? I heard USCIS will take picture during biometrics which is all they need. Can you please share your experiences on this. thanks a lot.
You need to send all the documents asap.They will send biometrics notice for E-filed EAD , but I am not sure about E-filed AP.

I am not negating anyone's personal decision here but after leaving for 10 yrs in US and still not having a GC makes me wonder why I should go to canada rather I would go to india and live there where we spent our 25 yrs or so and be part of the community etc.

I could not believe it either. My PD is August 2003 and EB3 from India. I have read many stories where people seem to have got GC when their PD is not current. In some cases, it appears they keep quiet about, but in some cases people seem to have corrected the situation to avoid any future complication, for example, if one decides to become U.S.Citizen at any point. It is just frustrating to think that I probably need to spend a lot of money on an attorney and go through the mental stress in resolving this because of probably an error some foolish clerk at USCIS made.
