    I cannot agree more with all the views. I have been here for over 5 years and couldn't find an employer to change to H-1B. L1 spouses can work and if the new immigration bill is passed a spouse of an illegal (who is legalizing now) via a low skilled job could also work, why can't we? We should have anyways.
    There is a bill called TALENT "Through the Advancement of Legal and Educated New Talent.” which if debated and approved would let H-4s work, how can this be done?

    we have to take the word from IV as truth but with a grain of salt. As unitednations alluded to, this push is coming from Employers. That should make us worry and STOP this grab.

    Believe me, efforts are underway full swing to grab these unused EB3 visas. Apart from the references I made in my post, I also am in touch with a Staffing firm that recruit nurses from non-US countires.
    We have discussed a lot about things in this forum. Every person came up different thought, links etc and moreover our goal of adding I-485 in this feb bill.

    After reading all the post mentioned by IV core, it is clear that no one can do anyting about it, there is no lobbyist that can force this to happen

    So our struggle is useless, some may not agree to it because, they say they are pushing and trying to make voice that can be heard by the congress.

    Congress did not listen to those million illegals on what grounds we expect our voice to be heard.

    I say it again, our struggle is useless. When they wish then only something might happen.

    With a due respect, I am differ with your statement on Competeamerica. Competeamerica has always promoted H1B and EB provision together. I haven't seen any time that they promoted only H1B.

    I spoke with one guy at Competeamerica and he told me that IV is neutral on H1B issue eventhough all members have came through that root. Personally I am very positive with Competeamerica and it is not good for us to speak negative for this organization.
    I know CA promotes both , but issue is whether they do that equally.
    I have a feeling h1b is more on agenda.
    Just that you belive what they are saying....either way u will see when h1b gets increased without eb reform.

    Yes, that is an issue. You will need to get an affidavit. The affidavit can be faxed or scan+emailed over to you.

    I dont know why people are thinking CIR will be advantageous :

    WHat does CIR do :

    Lets divide in to Four categories :

    1. PPL who has to still enter US
    2. PPL who have not started GC
    3. PPL whose Labor pending in BEC
    4. PPL whose 140 pending or approved.

    In each i have not seen advantages but these are disadvantages , please enlighten me about advantages over current system in each cases.

    Case -1: THere are enough provisions like Increase in H1B fees, Eliminating contracting etc that would effect and truely we may not be worrying about this in this context.

    Case -2: For people who have not stated GC yet , its utter chaos, as per the dates in CIR. Now point system is not tested, there are severe imbalancements , No up system yet in INS , no yet personnel allocation . I dont see any reason INS will be on to this even if passed for atleast 2 years.
    Based on this even if people say 5 years or so , no one exactly knows it might even take more than 7 years becoz of initial filing delays , accessing points , etc . What about extensions in H1B , anyways H1B system is so scrwed up consultants will be reduced by atleast 50% , and only survive who can find an work around. after all this High filing will force many out. I dont see anything good with new system. No big diff in Visa allocations to say that it will be faster for ppl. H1B Cant be renewed 3 years. Now is there any advantage over old sytem ? I dont think so .


    Case -3: People who were stuck in BEC. Its bigger problem for many people who are renewing H1 based on this. Now that cant do it . SO its again their issue.

    Case -4: People who got I140 approved or pending , They wont be effected anyways.


    Also there will be labor somewhere as becoz there will be some clause that aims at not displacing any american worker for sure.

    With all these there is only one drawback of current system , i.e. backlog. that is not addressed anyways in new system so whats the point?

    Only if cantwell amendment finds its place in current form then is a hope in a hurricane else its utter waste.

    And the worst thing is they approve it from the date tey approve it to 1 year after..My EAD which was expiring on 2th Sep'2008 was approved until Jun 20th 2009. Basically I got a 9 months extension...What a plan...

    That's ridiculous. Forget abt the 2 year EAD that you didn't get, you also lost 3 months? They probably hired some part time workers for last weekend who might have screwed up. I did some research before and am pretty sure they started issuing documents with a start after expiry of the first one a long time ago. Even on our AP's which were approved, the start date was september 2008. I got them mid -may..

    Sorry , but I dont think that it is possible to do that ...
    EB3 vs EB2 classifications depend on Job Description ie the description and education, experience requirement given at the labor certification stage.
    You can get labor certification which would satisfy EB2 class requirements and apply under EB3 for I140 .... but not the other way around. ...

    That means starting from scratch with PERM with a new Labor... loosing PD and back to square one ... obviously not worth it

    PD is not lost if you crossed I-140 stage (got an approval) on the older application.

    So do we have any update on this, will it be possible to get SSN for H4 dependents?

    So far things are looking good, but I have been instructed to not discuss any specifics until the lawyers have reviewed all the information. I should know more next week. I also received a call yesterday from a congressional office, but I was unavailable to take the call. We'll see what happens.

    Hi guys,

    I have just called the USCIS. They told me that the applications will not be rejected but just put on hold until our visa numbers will be avialiable ifor the nerw FY 2008.

    In addition she told me that the Nebraska office is sending back the filing receipt to the applicants which it should not affect our h1-b visa status in case we are going to travel.

    For the last part I do not believe her. Is there anyone else that can confirm that ?

    Everbody's posts here are speculations on what USCIS will do to I-485's filed on or after July 2. Everybody is trying to get an answer from USCIS. You called and got an answer DIRECTLY from USCIS which you doubt and don't believe. So what you want is for people here, who can only come up with speculations as to what USCIS's action would be, to confirm what USCIS already told you???

    Geez.....you definitely need a brain check.
