Yabadaba,
"Moron" is an insult. I don't insult anyone. If you don't like my posts, just ignore them.
Regards,
The Ombudsman
Its not an insult. Its a scientific classification for you.
"Moron was originally a scientific term, coined by psychologist Henry Goddard from a Greek word meaning "foolish" and used to describe a person with a genetically determined mental age between 8 and 12 on the Binet scale. It was also once applied to people with an IQ of 51-70 and was a step up from "imbecile" (IQ of 26-50) and two steps up from "idiot" (IQ of 0-25). The word moron, along with "retarded" and "feeble-minded" (among others), was once considered a valid descriptor in the psychological community, though these words have all now passed into common slang use, exclusively in a detrimental context."

This press release only shows that it is an administrative/executive fix. Either it is USCIS or DOS or the President, is what I do not know. But clearly, it is something not mandated by legislation, else USCIS/DOS would be breaking several laws by continuing to use the old bulletein.

EAD is issued to ALL 485 applicants based on pending I-485. As far as I know, "pending Adjustment of Status application" is the only criteria for 485. That means both the primary applicant and the spouse will get EAD irrespective of whether dates stay current retrogress as long as you applied for I-485.
Hope this helps.

Reading through this, this only says that the status cannot be changed (to a PR). It does not say that the prefiling of of AOS application cannot be done.
I think we should definitely try to work towards this. There was also an article on Immigration daily (http://www.ilw.com/articles/2009,0225-endelman.shtm) which suggests pre filing as a administrative fix that will solve a lot of problems. It argues that "there is nothing in the INA that compels a particular definition or understanding of what "immediate availability" means."
I am definitely in for such a initiative.
Incorrect! Please read again.
Section 1255. Adjustment of status of nonimmigrant to that of
person admitted for permanent residence
(a) Status as person admitted for permanent residence on application and
eligibility for immigrant visa
The status of an alien who was inspected and admitted or paroled
into the United States or the status of any other alien having an
approved petition for classification under subparagraph (A)(iii),
(A)(iv), (B)(ii), or (B)(iii) of section 1154(a)(1) of this title or \1\
may be adjusted by the Attorney General, in his discretion and under
such regulations as he may prescribe, to that of an alien lawfully
admitted for permanent residence if (1) the alien makes an application
for such adjustment, (2) the alien is eligible to receive an immigrant
visa and is admissible to the United States for permanent residence, and
(3) an immigrant visa is immediately available to him at the time his
application is filed.
This means that visa number must be available at the time of filing I-485.
Well, Read again. I hope it answers your question.
Here is the test from newsletter
What regulatory or legislative changes (including a possible pre-application filing procedure for adjustment cases) are recommended to facilitate caseload planning and make optimum use of U.S. Citizenship and Immigration Services adjudication capacity?

Its not over till its over :), and its not over yet by any means. I am willing to wait and fight ;) . Everyone has priorities in life, each person would view GC situation differently. For me, its not the ultimate dream, but just a vehicle to continue my journey for some more time (with peace of mind). I am definitely looking to gray my hair in my home country or atleast be there once I am grayed haired :D
Doing an MBA/PMI and looking for managerial job is the only realistic possibility for most, I don't think most people would wanna still be programming when they turn 40/45 (depending on how old/young you feel).
My gut feel is that there will be some kind of relief by end of 2007 or early 2008

I agree with you that it is worth waiting and fighting for.

This is yet another example of how the US is happy to tax us and let us finance Social Security, then place us in a similar category to "illegal aliens" when it suits them. Please give results on any legal redress as soon as you have them, as I will join also. I have already written to Congressman Chris Van Hollen of Maryland about this.

Sanju,
I did not expect such a cheap statement from a senior member like you. Infact posts like yours creates separate groups.
Please try to contribute towards achieving the goal. If you do not like our posts please ignore this thread.
Please do not call any one as IDIOT..
Thanks!
Look at the two group of idiots here, each one trying to agrue for a specific provision to benefit him ONLY, and finding foolish reasons to support their arguments. Insane idiots or educated illitrates? You deicde. Either way, they are both the same.

Well depends on the job I want to get done. New Internatinal graduates come with less salary, more enthusiam, are hardworking and would go out of their way to get some work done.
In addition to that if I have a constant supply of H1Bs why would I want to spend more money on high salary & more perks if I can train newbies in 6 months.
Good luck running your company! Just imagine this, you spend 6 months training an international grad, spend $5000 - $7000 per H1B and after 1 - 2 yrs, you will have to start all over again. After a couple of months, the "new hire" will just be angry at you (just look at all the people on this forum who curse bodyshoppers - and just to clarify - I am not implying that the company you start will be a bodyshopping firm) and he will quit your company and join someone else. And you will have to start the process all over again. The guy who you hired on H1B will be now join someone else and depending on your business, you will be left high and dry.
I know this because the very first job I joined, the philosophy at the company was to hire fresh grads (the "get them cheap" works for American Grads too). My boss used to tell me "we can get two for the price of one". The year I got hired, the company recruited 15 new grads (a new "Product Development" dept. was being started) - and I was the only H1B. After 14 months, when the business started picking up, the company did not even bother to raise our pay or even recogonize us. Guess what happened? Over a period of 2 months, 12 of us quit for better jobs. Guess who now had to look for 12 people and at the sametime deliver the product to the clients on time?
And the company was not even a "desi" company. During my time there, we used to discuss the book "Good to Great" and how we could make the company a Great Company. The management used to talk about getting the "right people on the bus". I guess finally the "right people" found out that the bus was not going their way and got off it.

As I said dont bother replying
Pay attention more to something when you read and ask your questions better (or at least elaborate before you reply with something like the above gem). And, since I suspect this is part of the problem look up "hypothetical". The correct term should have been "on or after July 2" not "after July 2". I didn't bother to sit there and make sure it was perfectly clear since I assumed readers would get it. Obviously, some are slow:D Peace
